What it is
The most serious class. It must be corrected IMMEDIATELY and certified to DOB's Administrative Enforcement Unit through DOB NOW: Safety. Class 2 and Class 3 have sixty days from service under the rule as amended in November 2022 — many City handouts still print forty, so work to forty and file even if it has passed. If re-inspection finds the condition still there, or no acceptable Certificate of Correction on file, DOB may impose a $5,000 civil penalty at construction sites over four families and re-inspect every 60 days. That $5,000 penalty does not apply to one- to four-family dwellings.
